What you need to know about Massachusetts’ Cannabis Laws

  • Both recreational and medical marijuana are legal in the state of Massachusetts for adults aged 21 and older
  • Massachusetts is home to 124 of marijuana dispensaries located across the state
  • It is legal to possess/transport up to one ounce of marijuana and have up to 10 ounces stored at home for adults aged 21 and older
  • It is legal to cultivate up to six mature plants per resident but no more than twelve plants per household
  • Currently in Massachusetts use of marijuana in public places is prohibited

Massachusetts Recreational Marijuana Laws

Marijuana was legalized for use by adults over the age of 21 in 2016. If you live in Massachusetts or are visiting the state, you may carry up to one ounce of marijuana and up to five grams of cannabis concentrate. Residents of Massachusetts growing marijuana are legally permitted to possess six mature plants per person but no more than 12 mature plants per residence. Recreational users are limited to purchasing up to one ounce of flower per visit.

Massachusetts law allows cities and towns to make their own laws on regulating marijuana. Since 2012 doctors in Massachusetts have been able to prescribe marijuana for qualifying patients. Qualifying conditions include Cancer, Parkinson’s Disease, Glaucoma, MS, among other debilitating medical conditions. There are no set restrictions on how much marijuana a patient may purchase aside from possessing a 60-day supply. All Massachusetts residents may legally grow up to six mature plants. Prior to recreational marijuana legislation, medical patients had to apply in order to be legally allowed to grow marijuana for themselves.

  • Public use or consumption of marijuana is illegal in Massachusetts. This includes sporting and music venues, state and national parks, campsites, bars, and restaurants.
